Hunting gear is designed to contribute to the comfort and safety of hunters as they pursue their prey. Camouflage has been used by hunters for years to help them blend into the environment and become less noticeable to the targeted game. Waterproof and insulated clothing can help keep hunters warm and dry. Blaze, or bright orange clothing, is required in some states because it is highly visible to other hunters and helps prevent shooting accidents.
Hunting vests have different designs for different types hunting, with features such as camouflage, leak proof game bags, pockets to hold ammo, padded backrests and seat cushions for comfort, and gun rests to hold a shotgun steady. Among other products, Hunter Safety System manufactures and sells a hunting vest for children called the Lil Treestalker, which comes with a tree strap for the purpose of safety.
Lawsuit for Unsafe Children’s Hunting Vest
Belt & Bruner, P.C. is pursuing a wrongful death
lawsuit on behalf of the parents who allege their child was killed while wearing the Lil Treestalker hunting vest. The lawsuit is captioned: JEREMY BRADBERRY, as Father and Next Friend of JUSTIN KADE BRADBERRY v. THE HUNTER SAFETY SYSTEM, INC., CV12-900172, CIRCUIT COURT OF CHILTON COUNTY, ALABAMA.
According to the allegations in the lawsuit, the tree strap on a vest got caught on the rear tire of an ATV, and Justin Kade Bradberry became entangled in his hunting vest and, tragically, died of asphyxiation.
The parents in this case contend that the Lil Treestalker harness was unreasonably dangerous in its design, and that the defendant, Hunter Safety System, Inc., failed to provide proper instructions or adequate warnings to give consumers notice of the dangers associated with using the harness. Hunter Safety System, Inc. manufacturers and sells other similar vests and many different models of harnesses.
